1. Booking Process

Unless agreed otherwise, the customer remains responsible for compliance with any external approvals required for the work.

Minor adjustments to the method of work may be made on site where necessary for safety, efficiency, or tree health. Such adjustments do not usually entitle the customer to a price reduction provided the overall scope of the job remains substantially the same. If a material change is required, we will discuss it with the customer before proceeding wherever practical.

3. Payments

Payment terms will be stated in the quotation or invoice. Unless otherwise agreed, payment is due in full upon completion of the work. For larger or scheduled jobs, we may require a deposit before the booking is secured. Deposits are used to reserve labour, equipment, and time, and may be non-refundable except where we are unable to attend or complete the work due to our own fault.

We may accept payment by bank transfer, card payment, or other methods agreed in advance. All prices are quoted in pounds sterling and may be subject to VAT where applicable. If the invoice is not paid by the due date, we reserve the right to charge reasonable recovery costs and interest on overdue sums in accordance with applicable law. The amount retained or charged will be reasonable and proportionate to the circumstances.

If access is not available on the agreed date, if the customer is not present where attendance is required, or if the site is otherwise not ready for the work to proceed, the appointment may be treated as a late cancellation. In such cases, a call-out fee or cancellation charge may apply. Repeated changes to dates or access arrangements may require the quotation to be reviewed, especially where equipment or crew allocation has been reserved.

We may cancel or postpone a booking where weather conditions, safety concerns, equipment failure, staff illness, legal restrictions, or circumstances beyond our reasonable control make attendance or completion impracticable. If we cancel for reasons within our control, we will refund any advance payment for work not carried out. If we are prevented from working by events outside our control, we will aim to rearrange the service, but we are not liable for losses arising from the delay except as required by law.

5. Customer Responsibilities

The customer must provide accurate information about the property, tree location, access routes, underground or overhead services, nearby structures, and any known hazards. They must ensure that the site is reasonably accessible at the agreed time and that pets, vehicles, garden furniture, fragile items, and other obstacles are removed or protected where necessary. The customer is also responsible for obtaining any permissions required from a landlord, freeholder, neighbour, local authority, managing agent, or other relevant person. Where permission is required and has not been obtained, we may refuse to proceed or may pause the work until documentation is provided. Any delay caused by missing permissions may be treated as a cancellation or rescheduling event at our discretion.

We will carry out all tree surgery work with reasonable care and skill. However, tree work involves natural materials, variable conditions, and physical hazards. We are not liable for defects, decay, structural instability, hidden cavities, underground obstructions, or other issues that were not reasonably visible or identifiable before the work began. Where a tree, hedge, stump, or surrounding feature is already weakened or unstable, we do not accept responsibility for failure that arises from that pre-existing condition unless the law requires otherwise.

To the fullest extent permitted by law, we are not responsible for indirect or consequential losses, including loss of profit, loss of enjoyment, business interruption, or damage caused by delays beyond our control. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law.

Any claim for property damage must be reported to us within a reasonable time after the event and, in any case, before the site or evidence has been altered where practicable. We may require photographs, repair estimates, or other supporting information to assess the matter. Our total liability for a claim, where liability is established, shall be limited to the amount paid or payable for the specific service giving rise to the claim, except where law provides otherwise.

We may decline any request that would place us in breach of our legal duties. Where necessary, we may keep records relating to waste movements, disposal, or transfer in line with legal and operational requirements.

8. Access, Safety, and Temporary Conditions

Tree surgery can require the use of ladders, ropes, climbing systems, chippers, saws, stump grinders, or powered equipment. The customer agrees to allow us reasonable access to the site for the purpose of delivering the service. We may ask that work areas are kept clear and that children, pets, and unauthorised persons remain away from active operations.

We may stop work temporarily if conditions become unsafe, including during high winds, heavy rain, lightning, poor visibility, unstable ground, or interference from third parties. The customer understands that safety decisions are made in our professional judgment and may affect completion times. If a task must be postponed due to unsafe conditions, we will arrange an alternative date where practical.

If any equipment, vehicle, or material is damaged by a hazard that was not reasonably disclosed by the customer, or by hidden conditions on the site, we may charge for additional time or recovery costs where lawful. We will always seek to minimise disruption and carry out the service in a controlled and careful manner.

9. Complaints and Remedies

If the customer is dissatisfied with any aspect of the service, they should notify us as soon as reasonably possible after completion. We may inspect the issue, request photographs, or arrange a follow-up visit to assess whether any remedial action is appropriate. Complaints should be made before any third party alters the relevant area, as later changes may make assessment impossible.

Where a service has not been carried out in accordance with the agreed scope, and the issue is our responsibility, we may choose to re-perform the relevant part of the work, offer a partial refund, or provide another reasonable remedy. This does not affect your statutory rights. No remedy will be provided for outcomes that were caused by factors outside our control, by inaccurate customer instructions, or by normal natural variation in living trees.

10. Governing Law

These Terms and Conditions, and any dispute or claim arising from them or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, unless mandatory law provides otherwise. If any provision of these terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed to the extent necessary and the remaining provisions shall continue in full force.

11. General Provisions

No failure or delay by us in exercising any right under these terms shall operate as a waiver of that right. Any waiver must be in writing. The customer may not transfer their rights or obligations under the agreement without our written consent. We may assign or subcontract any part of the service where reasonably necessary to complete the work, provided that we remain responsible for the service as agreed.

These terms form the entire agreement between the parties in relation to the service, except where expressly varied in writing. If there is any conflict between these terms and a specific written quotation or job confirmation, the latter shall prevail to the extent of the inconsistency.
